A proposed class action was commenced on January 18, 2024 in the Federal Court against the REBGV and about 100 real estate boards, associations (including CREA), and certain brokerages and franchisors across Canada that alleges that the operation of the respective boards’ MLS® violates the Competition Act

The allegations in this case are similar to those in another proposed class action in Federal Court brought by the same law firm against the Toronto Regional Real Estate Board, CREA and others. 

CREA has issued a summary of the two cases here. CREA considers the actions to be without merit. Like CREA, REBGV has engaged legal counsel and intends to vigorously defend the actions.   

As you can no doubt appreciate, this is a fluid and sensitive situation. As the matter is before the Courts, we do not intend to comment further about the merits of the claim at this time. We will, however, provide updates to our members from time to time on the progress of the action.
